Las 10 claves para entender qué pasa con la producción minera en esa provincia. Lo que se sabe y lo que se oculta.
La última ola de protestas en Jujuy se origina en varios puntos de la reforma de la Constitución provincial que la gestión de Gerrardo Morales pretende llevar adelante.
El del derecho a la protesta social es uno de los más conflictivos, al igual que el que busca modificar derechos y garantías de comunidades originarias que impactaría en la propiedad y uso de la tierra.
Eso está directamente relacionado con la concesión de proyectos mineros, en especial el litio.
Morales dio marcha atrás con dos de esos artículos resistidos.
1) ¿Qué dicen los artículos suspendidos?
El artículo 50 sostenía en su punto 2 que “el Estado es el encargado de reconocer tanto la personería jurídica de las comunidades dentro del territorio provincial como la posesión y propiedad comunitarias de las tierras que tradicionalmente ocupan…”. En el artículo 3 afirmaba que es el Estado quien “promueve la entrega de otras tierras aptas y suficientes para el desarrollo humano”.
El artículo 36 sobre el «derecho a la propiedad privada» incorpora «mecanismos y vías rápidas y expeditivas que protejan la propiedad privada y restablezcan cualquier alteración en la posesión, uso y goce de los bienes a favor de su titular», lo que dejaba lugar a múltiples interpretaciones en un territorio en el que la mayoría de las comunidades originarias carece de título de propiedad de sus tierras.
2) ¿Por qué es importante el litio en el mundo?
El litio se ha convertido en los últimos años en uno de los minerales que más interés despierta en el mundo, debido a su utilización en baterías para celulares, tablets, computadoras portátiles y, más recientemente, en vehículos eléctricos e híbridos.
Si bien se trata de un recurso relativamente abundante en nuestro planeta, son muy pocos los depósitos en los que se encuentran niveles de concentración suficientes para su explotación.
Argentina es uno de los cuatro productores mundiales más grandes de productos derivados del litio. Junto a Chile y Bolivia integra el “Triángulo del litio”, con un 65% de los recursos mundiales. Argentina y Chile producen actualmente 30% del litio en el mundo. Y sólo Argentina tiene el 20,5% de las reservas mundiales.
3) ¿Cuántos proyectos mineros de litio hay en Jujuy?
Hay cinco proyectos:
- Cauchari (Prefactibilidad). Empresa Lake Resources NL, Australia.
- Cauchari – Olaroz (Construcción) Ganfeng Lithium Co. Ltd., China.
- Salar de Cauchari (Prefactibilidad) Allkem Ltd., Australia.
- Salinas Grandes (Exploración Avanzada) Pluspetrol Resources, Países Bajos.
- Salar de Olaroz (Producción), Allkem Ltd., Australia. Es el único proyecto que ya produce y exporta litio.
4) ¿Cómo participa Jujuy de la actividad del litio?
A través de Jemse (Jujuy Energía y Minería Sociedad del Estado), la provincia participa con el 8,5% de las acciones del proyecto Salar de Olaroz, que controla la australiana Allkem y la japonesa Toyota.
5) ¿Cuántas regalías deja el litio en Jujuy?
Las regalías son del 3% sobre el valor de boca de mina (tal como es extraído). De todos modos, están reguladas por la Ley Fiscal N° 5.791 de 2014, que establece en algunos casos un descuento del 1% cuando el mineral o concentrado se industrializa en la provincia. Se aplica también a las operaciones que industrializan el carbonato de litio, lo que en esos casos llevaría la tasa efectiva a aproximadamente 1,6% sobre el valor de venta (2% boca de mina).
6) ¿Hay información del gobierno jujeño sobre los fondos que deja el litio?
No. No es posible acceder a ninguna información de ese tipo en el caso de Jemse. En ningún caso funcionaron las solicitudes de información efectuadas por RUIDO para el ifnorme Los dueños del litio en Argentina.
7) ¿Está publicado el contrato de concesión del litio con la empresa Allkem?
No. No se puede acceder al contrato de concesión de Jujuy con Allkem o con Toyota para la extracción de litio en el Salar de Olaroz.
8) ¿Adhirió Jujuy a las normas de transparencia en industrias extractivas?
No. Catamarca, Santa Cruz, Salta y San Juan adhirieron a la Iniciativa EITI de Transparencia para las Industrias Extractivas (Argentina lo hizo en 2019). Jujuy aún no decidió dicha adhesión.
En Jujuy, además, se dejó sin efecto por el decreto 9194 del 3 de mayo de 2019, una norma que exigía un análisis extra de los estudios de impacto ambientales sobre los proyectos mineros de primera categoría, como es el litio. Estaba a cargo de un Comité de Expertos para el Análisis Integral de Proyectos de Litio. Aseguran que esa tarea se superponía con la que realiza la Unidad de Gestión Ambiental Minera Provincial (Ugamp) como órgano consultivo multidisciplinario, integrado por diversos sectores.
9) ¿A qué país va la mayor parte del litio argentino?
A China. Si bien antes de 2022 el destino de las exportaciones de litio de Argentina estaba más diversificado (a varios países, empezando por EE.UU), desde ese año el principal comprador pasó a ser China, seguido de Japón.
China es uno de los países que más invierte en litio y en minería en general en Argentina. Es a la vez el origen del 13% de la producción mundial del mineral y el líder global en refinación.
10) ¿Qué efectos tiene para el ambiente la producción de litio?
Los principales cuestionamientos tienen que ver con el uso del agua y el destino de los residuos de la producción.
El 29 de marzo de 2023 La Corte Suprema de Justicia pidió informes al Estado Nacional y a las provincias de Salta y de Jujuy sobre las concesiones para la explotación de litio y borato en las Salinas Grandes.
Fue por un amparo ambiental de comunidades de pueblos originarios en su carácter de afectadas directas en sus derechos a un ambiente sano, a la vida, al agua y a la autodeterminación.
