En marco de una causa, donde se investiga un robo doblemente calificado – por escalamiento y por efracción – este domingo, se desarrolló en Villa Mercedes una audiencia de formulación de cargos. La Dra. María Antonella Panero Magnano, como subrogante en el Juzgado de Garantía N° 2 de la Segunda Circunscripción Judicial, otorgó al imputado un plazo de prórroga de la detención, que vencerá el próximo viernes.
Cabe mencionar que la audiencia fue solicitada – según lo previsto en el Art. 110 del Código de Procedimiento Penal de la provincia- por la Fiscal de Instrucción N° 2, Dra. Daniela Torres, conjuntamente con la fiscal adjunta, Dra. Andrea Aguilar, quienes investigan a un hombre, considerado provisoriamente co autor del delito de robo doblemente calificado por escalamiento y efracción, en los términos de los Art. 167 Inc. 3 y 4 en relación con el Art. 164 Inc. 4 del Código Penal de la Nación Argentina.
ARTÍCULO 110.- AUDIENCIA DE FORMULACIÓN DE CARGOS. Cuando el Fiscal deba formalizar la investigación preparatoria respecto de un imputado que no se encontrare detenido, solicitará al Juez la realización de una audiencia, individualizando al imputado. A esta audiencia se citará al imputado, a su defensor, y le informará los hechos que se le atribuyen, descriptos en la forma más precisa y circunstanciada que permita el grado de verificación que haya alcanzado la investigación; le indicará las pruebas de cargo que considera suficientes para atribuirle los hechos; y le hará saber la tipificación penal que provisionalmente le adjudica a los hechos. También podrán asistir la víctima y las demás partes en el procedimiento.-
Si el imputado se encontrare detenido, la formulación de cargos se hará dentro de las VEINTICUATRO (24) horas.-
Este término puede prorrogarse por VEINTICUATRO (24) horas, si el imputado lo pidiese para nombrar defensor.-
